TERMS AND CONDITIONS

The purpose of this document is to provide the necessary information for contracting our services, as well as the required terms and conditions that must be observed.

GENERAL CONTRACTING CONDITIONS

  • CLIENTS: Any person who contracts our services. For the purposes of this document, they shall be referred to as THE CLIENT
  • SERVICES: Refers to those services, tours, hotels, restaurants, train tickets, airfare, etc., that were contracted by the clients through the agency. For the purposes of this document, these shall be referred to as TOURIST SERVICES
  • AGENCY: Inversiones Turísticas Itur SAC, with RUC 20601422698, is the owner of the Incari Travel brand, through which various services are offered to our clients. For the purposes of this document, it shall be referred to as THE AGENCY
  • PRICE: The prices of our TOURIST SERVICES are expressed in U.S. Dollars (USD). Conversion to national currency (PEN) is determined by the exchange rate set by THE AGENCY in effect on the date of each payment. Any variation in the offered prices may be subject to review by THE CLIENT
  • RESERVATION AMOUNT: THE AGENCY requires a deposit of 50% of the total value of the TOURIST SERVICE to be contracted. This amount may only decrease or increase upon express communication from our agents. It is understood that for train tickets, Machu Picchu entry fees, airfare, and others, a 100% deposit will be required
  • THE CLIENT must pay the outstanding balance upon arrival in Peru, in the city indicated by our travel agents. Payment can be made in cash or by credit card (if paying by credit card, a 6% surcharge will be applied to the amount due). All transaction or transfer fees for the reservation deposit must be fully covered by THE CLIENT

THE AGENCY acts as both a tour operator and an intermediary between THE CLIENT and the TOURIST SERVICES of providers approved by THE AGENCY (“The Providers”).

THE AGENCY offers the TOURIST SERVICES of THE PROVIDERS solely as a mediator for promotion through its various sales channels. Therefore, it is not responsible for the service level or any damage occurring during the execution of the TOURIST SERVICES.

All TOURIST SERVICES provided on our website, as well as through different customer service channels and social media, are subject to these Terms and Conditions and other incorporated policies. We strongly suggest you thoroughly read and review the details of these terms

PASSENGER INFORMATION AND RESPONSIBILITIES

  • To proceed with the reservation of any TOURIST SERVICE, THE AGENCY requests personal information from THE CLIENT. This information will be handled with strict confidentiality by our travel agents and used solely for booking purposes.
  • THE CLIENT must comply with all current legislation applicable to their case. It is the sole responsibility of THE CLIENT to possess all personal and family documentation required by the corresponding immigration authorities.
  • THE CLIENT must provide a photo of their passport page containing the entry stamp to Peru (indicating the entry date), as this document exempts foreign tourists from domestic taxes (IGV).
  • It is the responsibility of THE CLIENT to carry a valid passport (which must be valid for at least 6 months beyond the travel date). Otherwise, THE AGENCY assumes no responsibility for issues at the airport during boarding, and the reservation will be forfeited.
  • THE CLIENT is responsible for any minors traveling with them. If a minor is traveling with only one parent or a guardian, a notarized permit authorized by the parents must be presented. If payment has been made but this documentation is not presented, the service will not be provided, and a 100% penalty will apply.
  • THE CLIENT formally authorizes THE AGENCY to take photographs and/or recordings of him/her before, during, and after the execution of the TOURIST SERVICES to publish and promote this material across media channels deemed appropriate by THE AGENCY, in perpetuity and worldwide.
  • We are committed to protecting your privacy. Please review our Privacy and Personal Data Protection Policy.
  • While receiving a contracted TOURIST SERVICE, THE CLIENT is responsible for carrying a valid passport required for entry, exit, and travel within each country or región visited, as well as all visas, permits, certificates (including vaccination certificates), and insurance policies.
  • THE CLIENT accepts full responsibility for obtaining all necessary documents prior to the start of the contracted TOURIST SERVICES and is solely responsible for any adverse consequences resulting from missing or defective documentation.
  • For hiking and/or adventure excursions, it is mandatory for CLIENTS over the age of 65 to provide a medical certificate of good health.
  • THE CLIENT is responsible for purchasing travel insurance before leaving their home country.
  • If THE CLIENT exhibits symptoms of intoxication, use of toxic substances, or mental health disturbances, we reserve the right to suspend the contracted service for safety reasons.
  • It is the responsibility of THE CLIENT to notify THE AGENCY in advance and before the start of the contracted TOURIST SERVICES of any ailment, allergy, illness, and/or disability that might interfere with the normal execution of the contracted activity.

RESERVATIONS, PAYMENT METHODS, AND BALANCE

  • To confirm the reservation of any of our TOURIST SERVICES, an initial payment of 50% of the total price of the requested services must be made (this percentage may vary based on direct negotiation with your travel agent). We offer the following payment methods:
    • Credit or Debit Card via our website: VISA, MasterCard, American Express, and Diners Club.
    • Online Payments via PayPal.
    • Money Transfers through Western Union or Money Gram agents.
  • Transaction Fees: Please note that payments made via credit/debit cards or PayPal incur a 6% commission fee. It is important to emphasize that THE CLIENT shall bear these costs.
  • All prices are expressed in S. Dollars (USD) and include applicable taxes and fees for foreign tourists and Peruvians residing abroad. In the case of foreign tourists residing in Peru or Peruvian travelers, you must notify your travel agent so the applicable IGV (Sales Tax) can be added.
  • Once we receive your personal information and the 50% deposit for the requested services, we will send you an email or WhatsApp communication within 48 hours with the confirmation of the contracted services and the respective reservation voucher.
  • The remaining balance must be paid upon your arrival in the city of Cusco (or the city determined by your travel agent) before the start of the contracted TOURIST SERVICES.
  • Non-Payment: Failure to pay the outstanding balance will result in the inability to participate in the contracted TOURIST SERVICES.

REFUNDS, CANCELLATIONS, RESCHEDULING, AND MODIFICATIONS

THE CLIENT has the full right to request the cancellation of the contracted TOURIST SERVICES, as well as to request a refund of the amount paid.

    • Any cancellation of the CONTRACTED SERVICE by the CLIENT must be submitted in writing. THE CLIENT shall be responsible for the following costs:
      1. Administrative Fees: 10% of the total value of the CONTRACTED SERVICE.
      2. Cancellation Charges: Any additional costs incurred (penalties from tourism providers, hotels, restaurants, guides, transportation, etc.).
  •  In the event of a cancellation request made up to 30 days prior to the start of the tour, 50% of the initial deposit will be refunded.
  • It is important to emphasize that airfare, train tickets, Inca Trail permits, and Machu Picchu entry tickets, among others, do not allow modifications for any reason. Therefore, the cancellation of these services results in a 100% penalty (loss of the full amount paid for said permits, entries, or tickets).
  • No-Shows: Failure to arrive at the scheduled departure time without prior documented cancellation, or arriving late, will result in the total loss of the payment and the SERVICE.
  • Special Cancellation Conditions: Certain contracted services are subject to special economic conditions where 100% of the fare must be paid once issued, regardless of how far in advance the cancellation occurs (e.g., air tickets, accommodations, pre-purchased Inca Trail slots, entry tickets to Machu Picchu or Huayna Picchu, etc.).
  • Rescheduling and Modifications: Any request by THE CLIENT to reschedule or modify a service within 10 days of the start date will be accepted only if the third-party provider permits it and there is no price difference for the new date. Otherwise, THE CLIENT must cover any additional costs involved in the rescheduling or modification.

  • Voluntary Withdrawal: No refunds will be provided once services are underway and proceeding as scheduled if THE CLIENT voluntarily decides not to continue with them.
  • The following criteria are grounds for suspending the reserved services:
    • Social Unrest: Strikes, protests, and similar disturbances.
    • Health Conditions: Inadequate health status of the passenger.
    • Substance Use: Conditions resulting from the consumption of alcohol and/or toxic substances.
    • Emergency Zones: Areas declared as an emergency zone by the State or an authorized government office.
    • Mutual Agreement: By common consent with the client.
    • Group Departure: If the client decides to leave the group.
    • Natural Disasters.
  • Agency Authority: Please be advised that THE AGENCY, prioritizing the physical integrity and safety of THE CLIENT, reserves the right to make modifications to the CONTRACTED SERVICES or to cancel them entirely if necessary.

CONCLUSIONS

  • THE CLIENT acknowledges and accepts the contents of the TERMS AND CONDITIONS set forth in this document. Furthermore, THE AGENCY shall be exempt from all liability for inconveniences that may arise, as it is expressly stated that THE CLIENT has been duly advised with this information.
  • In accordance with the Code of Consumer Protection and Defense, Law No. 29571, our platform provides a Virtual Complaints Book (Libro de Reclamaciones). You may file a complaint or claim regarding the services offered on our platform by visiting the “Contact Us” section.
  • THE AGENCY reserves the right to change and adjust these Terms and Conditions to balance and improve the contractual relationship of all parties involved. Any changes that do not provide a direct benefit to THE CLIENT or the Provider shall only be made due to legal or technical requirements.
  • This agreement is governed by the laws of the Republic of Peru.
